再谈船舶生活污水排放要求的法律界定

摘 要：针对我国沿海航行船舶生活污水管理的现状，比较分析了我国对于沿海以及国际航行船舶生活污水排放的不同法律规定，认为国内航行船舶排放生活污水应当遵从国内标准，以及船舶在港内排放经处理的生活污水当属合法的结论。同时对如何完善我国对船舶生活污水管理提出了建议。

Re-discussion on the Lawful Boundaries of Ship’s Sewage Discharging

Abstract: For the actuality of the sewage management about domestic voyage ship, using the methods of the comparatively analysis analyzed the different discharging requirements of domestic voyage and overseas voyage. The conclusion is that discharging sewage by domestic ship should obey the state standard, otherwise if the ship discharging the sewage which final disposed is lawful. The suggestion of improving ways about sewage management was put forward.

引言

《防止船舶生活污水污染规则》（MARPOL公约附则Ⅳ）已经对我国生效，但业内人士在公约执行过程中仍存在着分歧，如对公约的适用范围、排放要求理解不一等。同时针对船舶是否可以在港内排放经处理的生活污水及国内航行船舶如何执行排放标准的把握方面，存在着截然相反的两种观点。无论是航运界还是海事部门，掌握并准确的执行公约规定，避免由此产生不当的PSC行动和行政处罚都十分必要。本文以国内船舶生活污水排放现状为切入点，深入分析了船舶
